Digital Millennium Copyright Act Notice & Takedown Procedures
1. Overview
Writer's Web Dream respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform.
2. Reporting Copyright Infringement
If you believe that content hosted on Writer's Web Dream infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:
- Your full legal name and contact information (address, phone, email).
- A description of the copyrighted work you claim has been infringed.
- The URL or location of the infringing material on our platform.
- A description of the infringing material.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your electronic or physical signature.
3. How We Respond
Upon receiving a valid DMCA takedown notice, we will:
- Review the claim within 1-3 business days.
- Remove or disable access to the allegedly infringing content.
- Notify the user who posted the content about the claim.
- Provide the accused user an opportunity to file a counter-notice.
4. Counter-Notification
If you believe your content was removed in error, you may file a counter-notice. Your counter-notice must include:
- Your name, address, and phone number.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you believe the material was removed by mistake or misidentification.
- A statement consenting to the jurisdiction of your local federal court.
- Your physical or electronic signature.
Upon receiving a valid counter-notice, we will forward it to the original claimant. If the claimant does not file a court action within 10-14 business days, we may restore the removed content.
5. Repeat Infringers
In accordance with the DMCA, we maintain a policy of terminating the accounts of users who are repeat copyright infringers in appropriate circumstances.
6. Good Faith
Warning: Filing a false DMCA takedown notice is punishable under federal law. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that content is infringing may be liable for damages, including costs and attorney's fees.
